INTRODUCTION

Established in 1995, the WTO which is based on the old GATT Agreement, creates a system for efficiently regulating international trade. ELSA’s aim for the competition is to encourage further developments on the subject matter in the curriculum of academic institutions globally and to contribute to the ongoing discussion about globalisation in the context of the WTO Agreements.

REGIONAL ROUNDS

For 2006, ELSA has announced that four (4) non-ELSA regional oral rounds will be conducted: South East Asia & Pacific; Asia; South West Asia-Sub-continent and Latin America. These Regional Rounds will serve as the entry mechanism for teams coming from universities with law and/or business faculties, that are accredited under national law and which award degrees permitting graduates to enter the legal profession as per Rules 2.1, 2.2 and 2.3 of the Rules of the ELSA Moot Court Competition (EMC²).

ELSA’s International Organising Committee (IOC) has re-appointed former WTO Deputy Director-General (1999-2002), Mr Andrew L. Stoler and the Institute for International Business, Economics and Law (IIBE&L) – The University of Adelaide as the Regional Round Administrator and Organiser of the expanded South East Asia & Pacific non-ELSA Regional Round (The SEA&P).

Universities located in the following WTO Member and Observer States have been geo-politically attributed by the IOC to the SEA&P Regional Round: Australia, New Zealand, Fiji, Papua New Guinea, Singapore, Malaysia, Indonesia, Brunei, Thailand, Vietnam, Cambodia and Laos.

EMC² REGIONAL ROUND COMPETITION

Judging

The oral rounds will be judged by WTO Law and/or International Trade Law experts from the respective WTO Member and Observer states geo-politically attributed to the SEA&P Regional Round. All judges will be nominated and selected by the EMC² Asia-Pacific Academic Supervisor and SEA&P Administrator per Rule 1.5.2.

The Written Submissions for the SEA&P Regional Round will also be judged by a pool of WTO Law and/or International Trade Law specialists as nominated by the EMC² Asia-Pacific Academic Supervisor as per Rule 1.5.1.

Special SEA&P Regional Round Rule

*Teams are required to monitor this section of the SEA&P Regional Round competition for new Special Regional Rules.

i) Number of Teams
Pursuant to Rule 2.1 of the Rules only one team per Law Faculty (Law School, University) is permitted to enter the 2006 SEA&P Regional Round.

ii) Registration Process
Pursuant to Rule 2.5 of the Rules participants of the SEA&P Regional Round must send (mail, or fax or email IOC and the SEA&P Event Co-ordinator) the completed Team Registration Forms to both the IOC and IIBE&L by Thursday, 15th November 2005. Late Registration, will be accepted by the IOC and IIBE&L up until and include Saturday, 1st December 2005, but is subject to penalties.

iii) Registration Fee
Pursuant to Rule 2.6.1 of the Rules of the ELSA Moot Court Competition, the Registration Fee for the SEA&P Regional Round shall consist of two parts: domestic and international.

1. International
   - Registration Fee non-ELSA Regional Round of the EMC² 2005 – 100 Euro per team (due by 15th November 2005)
   - Registration Late Fee non-ELSA Regional Round of the EMC² 2005 – 150 Euro per team (if paid between 16th November and 1st December 2005)
   
   
2. Domestic (SEA&P) Regional Round
   
   Australian Universities: please note that under Australian tax law all services provided must include a GST component.
   * Registration Fee – $2475 AUD (inclusive of GST) per team (due by 15th November 2005)
   * Registration Late Fee – $2640 AUD (inclusive of GST) per team (if paid between 16th November and 1st December 2005)
   
   Non-Australian Universities: under Australian tax law, non-Australian universities are exempt from GST.
   * Registration Fee – $2250 AUD (excluding Australian GST) per team (due by 15th November 2005)
   * Registration Late Fee – $2400 AUD (excluding Australian GST) per team (if paid between 16th November and 1st December 2005)
   * As the SEA&P Regional Round Co-ordinator must collect both Registration Fees and transfer the respective International part (Euro 100) to the IOC, for your convenience the Euro portion has been included in the above Australian Dollar Registration Fee.
   
   The Registration Fee Includes:
   * Entry into the SEA&P Regional Round
   * Meals as follows for up to four registered team members and one team coach/academic advisor:
   Welcome Reception on 15th March; Lunch on 16th and 17th March and Presentation Dinner on 18th March.
   
   The Registration Fee Does Not Include:
   * Airfares/travel arrangements to Adelaide
   * Accommodation
   * Transfers between Adelaide Airport and your accommodation
   * Transfers between your accommodation and the National Wine Centre
   * Meals and beverages not specified

iv) Payment of Registration Fees
Please contact the SEA&P Regional Round Event Co-ordinator to arrange payment.

v) Cancellation
Registration cancellations must be made in writing to the SEA&P Regional Round Event Co-ordinator, either by mail, fax or email. Cancellations received three weeks prior to the event will be refunded less 25% administration costs. No Registration refunds will be made after 21st February 2006 other than in exceptional circumstances and at the discretion of the SEA&P Regional Round National Administrator.

vi) Team Identification and Anonymity
Per Rule 2.7, upon close of Team Registration, each team will be assigned a Number by the IOC as per the Timeline (Saturday, 15th December 2006). The number will be distributed to teams together with confirmation of their Registration. All references to competition participants will be via the IOC assigned Team Number, therefore SEA&P registered teams should include this number in any communications with either the SEA&P Event Co-ordinator or the Asia-Pacific Academic Supervisor.

vii) Submission of Written Memorials
In addition to Rule 4.1 of the Rules and Appendix A - Form Requirements for Written Submissions and Written Summaries of Oral Pleadings, teams entered into the SEA&P Regional Round must follow Rule 4.2 as follows:

a) Electronic copies of Written Submission – One electronic copy of each Complainant and Respondent's Written Submissions must be transmitted by email to the IOC and the SEA&P Event Co-ordinator by 24:00 hours Central European Time (12.00 midnight) Sunday, 15th January 2006 (see below for local time conversion).

b) Hard copies of Written Submissions – Teams must submit one (1) hard copy of each Written Submission to the IOC and three (3) hard copies of each Written Submission to the SEA&P Regional Round Organiser. All hard copies must be sent by Registered Mail, Express Mail or Courier to the following addresses:

Failure to follow this Special Regional Round rule will incur penalties pursuant to Rule 4.4.1 of the Rules of the ELSA Moot Court Competition.

*Please note that the Written Submissions are NOT exchanged in the EMC² competition because they do not form part of the score for the oral compeition. The Written Submissions are only utilised when a tie in the oral rankings occurs. For details of the application of the Written Submission scores, please read Rules 5.4.3 (Final Oral Round) and 6.2.3 (Regional Rounds).

viii) Written Submissions for Oral Rounds
Rule 5.5.5 requires teams progressing to the Final Oral Round to prepare and send to the IOC a five page summary of their oral pleadings. This document must reach the IOC not later than ten (10) days prior to the commencement of the Final Oral Round.

Please note that this rule does not apply to the SEA&P non -ELSA Regional Round.

ix) Final Oral Round
Pursuant to Article 6.2 of the Memorandum of Understanding between ELSA International and IIBE&L, the IOC shall accept SEA&P RR teams to the Final Oral Round as per the following:

a) One (1) team to the Final Oral Round from the SEA&P RR when up to eight (8) or less teams have registered to compete in the SEA&P; or
b) Two (2) teams (the winner and the runner up of the SEA&P RR) will be accepted to participate in the Final Oral Round when nine (9) or more teams have registered to compete in the SEA&P Regional Round.

The number of teams registered in the SEA&P Regional Round will be advised to competitors on Saturday, 15th December 2005.

The team(s) progressing to the Final Oral Round, to be held in Geneva from 26th April to 20th April 2006, will be required to complete Team Confirmation Forms. These Forms will be emailed to the Teams the week following the SEA&P competition and must be returned by email to the IOC by 1st April 2006. The information contained in the Team Confirmation Forms will be used by the IOC to gain security access for Team Members into the WTO. Failure to provide these details by the stated date may result in a team being denied entry into the Final Oral Round.

Team(s) progressing to the Final Oral Round must inform the IOC of any guests who will attend the Preliminary Rounds. If such guests wish to also participate in the social program and/or attend the Finals at the WTO, guest participation fees will be charged by the IOC. In addition, such arrangements must be made direct with the IOC prior to the 1st April 2006. Due to security reasons, no guests can be accepted after this date.

A Participation Fee of Euro 80 per day/per person shall be paide by all Team Members and Coach/Academic Advisor who participate in the Final Oral Round. The Participation Fee includes academic and social program, accommodation (in twin rooms only), meals and administration costs. The IOC will issue Invoices to all eligible teams as per the Timeline. It is the responsibility of each Team to transfer the Invoice Amount, by the due date, directly to the IOC’s bank account in Brussels.

National Wine Centre - How to Get Here
The National Wine Centre of Australia is adjacent to the Botanic Gardens of Adelaide, in the north east part of the City. The pedestrian entrance is located on Botanic Road, the continuation of North Terrace. You can also walk through the Botanic Gardens to the Centre.

By Bus
The National Wine Centre is easily accessible by public transport.
The Adelaide Free Buses - catch the City Loop (99C) around the city and stop at Botanic Gardens/East Terrace. The Botanic Road entrance to National Wine Centre is approximately 200 metres walk East.

Adelaide Metro buses including the O-Bahn bring you to the National Wine Centre bus stop either on Botanic Road (stop 1) or on Hackney Road (stop 2) . The Adelaide Explorer bus also stops at key visitor attractions around Adelaide, including the National Wine Centre.
